1. Story of the Day: Kimmy Krypto

The SEC announced charges against Kim Kardashian yesterday for her role in a ā€˜pump-and-dumpā€™ crypto scheme. Kim, who hyped up the crypto token ā€˜EMAXā€™ and advertised the coin on her Instagram, failed to disclose she was paid $250,000 to promote it.Ā

Kim joined forces with Floyd Meriweather and retired NBA player Paul Pierce in promoting EMAX tokens on social media in June 2022. A class-action lawsuit alleged Kim and company had improperly created substantial demand, ultimately allowing investors to sell their tokens for a significant profit. A mere month later, the EMAX token price had fallen by 98%.

The SEC announced a resolution culminating in Kim paying a $1 million penalty as well as an additional $260,000 in disgorgement fees to settle civil charges. Regulatory scrutiny of the crypto industry has made significant waves over the past several months, and agencies such as the SEC are especially skeptical of celebrity crypto endorsements.

Short Squeez Takeaway: US regulators are coming for crypto. Amidst a record $30 billion flooding into the digital asset industry last year coupled with disgruntled investors during a crypto winter, regulators are treating crypto ā€˜pump-and-dumpā€™ schemes similarly to how they would treat equity ones. The SECā€™s response to Kimā€™s crypto promotions drops the hammer on how they perceive social media advertisements; neither celebrities nor Instagram posts are immune from regulatory scrutiny in their eyes.

2. Markets Rundown

US stocks kicked October off on a strong note Monday after the S&P 500 and Nasdaq Composite closed out their first three-quarter losing streak since the 2008 Global Financial Crisis and the Dow logged its first such span of losses since 2015.
